Christine Clavien and Samia Hurst (henceforth C-H) make at least three valuable contributions to the literature on responsibility and healthcare. They offer an admirably clear and workable set of criteria for determining a patient's degree of responsibility for her health condition; they deploy those criteria to cast doubt on the view that patients with lifestyle-related conditions are typically significantly responsible for their conditions; and they outline several practical difficulties that would be raised by any attempt to introduce responsibility-sensitive healthcare funding. (...) I am sympathetic to the general thrust of their argument, share—at least tentatively—their policy conclusions, and was persuaded by much of the detail of their argument. Imagine both that (1) S1 is deliberating at t about whether or not to x at t' and that (2) although S1’s x-ing at t' would not itself have good consequences, good consequences would ensue if both S1 x's at t' and S2 y's at t", where S1 may or may not be identical to S2 and where t < t' ≤ t". In this paper, I consider how consequentialists should treat S2 and the possibility that S2 will y at (...) t". At one end of the spectrum, consequentialists would hold that, in deciding whether or not to x at t', S1 should always treat S2 as a force of nature over which she has no control and, thus, treat the possibility that S2 will y at t" as she would the possibility that a hurricane will take a certain path. On this view, S1 is to predict whether or not S2 will y and act accordingly. At the other end of the spectrum, consequentialists would hold that S1 should always treat S2 as someone available for mutual cooperation and, thus, treat the possibility that S2 will y at t" as something to be relied upon. On this view, S1 is to rely on S2’s cooperation and so play her part in the best cooperative scheme involving the two of them. A third and intermediate position would be to hold that whether S1 should treat S2 as a force of nature or as someone available for mutual cooperation depends on whether S1 can see to it that S2 will y at t" by, say, having the right set attitudes. I’ll argue for this third position. As we’ll see, an important implication of this view is that consequentialists should be concerned not just with an agent’s voluntary actions but also with their involuntary acquisitions of various mental attitudes, such as beliefs, desires, and intentions. Indeed, I will argue that consequentialists should hold both that (1) an agent’s most fundamental duty is to have all those attitudes that she has decisive reason to have and only those attitudes that she has sufficient reason to have and that (2) she has a derivative duty to perform an act x if and only if her fulfilling this fundamental duty ensures that she x’s. Thus, I argue (as Donald Regan did before me) that consequentialism should not be exclusively act-orientated – that it should require agents not only to perform certain voluntary actions but also to have certain attitudes. In the process, I develop a new version of consequentialism, which I call attitude-consequentialism. In this paper, I will reread the history of molecular genetics from a psychoanalytical angle, analysing it as a case history. Building on the developmental theories of Freud and his followers, I will distinguish four stages, namely: (1) oedipal childhood, notably the epoch of model building (1943–1953); (2) the latency period, with a focus on the development of basic skills (1953–1989); (3) adolescence, exemplified by the Human Genome Project, with its fierce conflicts, great expectations and grandiose claims (1989–2003) and (4) (...) adulthood (2003–present) during which revolutionary research areas such as molecular biology and genomics have achieved a certain level of normalcy—have evolved into a normal science. I will indicate how a psychoanalytical assessment conducted in this manner may help us to interpret and address some of the key normative issues that have been raised with regard to molecular genetics over the years, such as ‘relevance’, ‘responsible innovation’ and ‘promise management’. Um saco misto dominado pelo absurdo reducionista da H & D. Esta é uma continuação do famoso (ou infame como eu diria agora, considerando seu absurdo implacável) Godel, Escher, Bach (1980). Assim como seu antecessor, preocupa-se em grande parte com os fundamentos da inteligência artificial, mas é composto principalmente por histórias, ensaios e extratos de uma ampla gama de pessoas, com alguns ensaios de DH e DD e comentários para todas as contribuições de um ou outro deles. Este es un seguimiento del famoso Hofstadter (o infame como diría ahora, teniendo en cuenta sus incesantes tonterías) Godel, Escher, Bach (1980). Additional problems for reductionism are the uncertainty principle, chaos (e.g., no way to predict how a pile of sand will fall), the logically necessary incompleteness of math (and all thought) and the impossibility of matching higher order behaviors (e.g., language) with lower order phenomena (e.g., biochemistry), i.e., the combinatorial explosion or underdetermination. OBJETIVO -/- O estudante de Zootecnia e de Veterinária, quando se depara com a produção animal, um dos pilares importantes é a reprodução, uma vez que é a perpetuação da espécie, seja para gerar filhas de uma vaca campeã em produção leiteira e de um touro com rusticidade e com aptidão produtiva de corte, ou mesmo para reposição de um plantel, o mesmo deve estar consciente de que esse ramo é de extrema responsabilidade, já que estará intimamente lidando com a (...) vida e com um investimento que pode gerar lucros em demasia para a propriedade ou, se mal feito o manejo da reprodução, trazer sérios transtornos para a mesma. -/- Nesse trabalho, o estudante revisará os sucessos da puberdade e estacionalidade reprodutiva relacionando-os com os processos endócrinos e os fatores que afetam sua manifestação como os nutricionais, para compreender a maneira ao qual podem ser manipuladas. -/- -/- • _____INTRODUÇÃO -/- A puberdade marca o início da vida reprodutiva do animal, permitindo integrar o indivíduo ao seu ciclo produtivo. A estacionalidade é uma característica de adaptação que algumas espécies desenvolveram para fazer garantir a eficiência da reprodução e a sobrevivência dos filhotes. -/- -/- • _____PUBERDADE -/- A puberdade é atingida quando o animal é capaz de produzir e liberar gametas viáveis e funcionais (férteis). Na fêmea esse fato ocorre na primeira ovulação, que geralmente coincide com a manifestação do comportamento do cio; e nos machos durante a primeira ejaculação com espermatozoides viáveis. -/- Do ponto de vista da produção animal, puberdade prematura ou precoce, é importante para poder permitir a incorporação dos animais ao ciclo produtivo o mais rapidamente possível. No caso de touros holandeses, por exemplo, é desejável que produzam sêmen precocemente para incorporá-los a prova de progênie; nas fêmeas, entretanto, deve-se considerar que nem sempre é conveniente usar o primeiro ciclo ou cio para reprodução. É o caso das marrãs (porcas primíparas), onde é benéfico esperar até o segundo ou terceiro estro para aumentar o tamanho da ninhada. Também pode ser vantajoso esperar que o indivíduo alcance sua maturidade sexual, que ocorre quando a fêmea consegue se reproduzir sem sofrer efeitos adversos. A ovelha nascida na primavera, por exemplo, pode engravidar no outono seguinte e dar à luz no primeiro ano de vida, mas seu crescimento pode ser afetado; o mesmo ocorre com a novilha, em que o acasalamento precoce pode promover distorcia por falta de desenvolvimento pélvico. -/- A puberdade é um processo gradual e está intimamente relacionada à taxa de crescimento e ao metabolismo energético. O recém-nascido usa energia para funções vitais, principalmente termorregulação; esse feito se deve ao fato de os jovens possuírem uma superfície corporal muito elevada em relação ao seu volume. Durante o desenvolvi-mento subsequente dos tecidos também há prioridade no uso de nutrientes, que inicialmente favorecem o desenvolvimento do tecido ósseo e muscular, e uma vez que estes atingem determinado tamanho de acordo com as condições genéticas do indivíduo, inicia-se o desenvolvimento do tecido adiposo, que é indicativa de um reservatório de energia. É importante ressaltar que existe uma interação entre a genética e o meio ambiente, de forma que o potencial genético só será expresso se o meio ambiente for favorável. -/- Para que a ovulação ocorra, é necessário considerar o funcionamento do eixo hipotálamo-hipófise-gonodal. O aumento da frequência pulsátil do GnRH hipotalâmico e em consequência do LH hipofisário provoca a maturação do folículo em nível gonodal, o que aumenta a produção de estrógenos. O aumento dos estrogênios causa, por feedback positivo no hipotálamo, a liberação do pico pré-ovulatório de LH e, consequentemente, a ovulação. Na fase pré-púbere, a frequência dos pulsos de GnRH e LH é muito baixa e insuficiente para provocar a maturação folicular, pois o hipotálamo é inibido e, portanto, não ocorre ovulação. -/- A geração pulsátil de GnRH no momento reprodutivo adequado para desencadear o início da puberdade depende de uma rede neural complexa que, além dos neurônios GnRH, inclui outros neurônios e células da glia; ele também integra vários sinais internos e externos para o corpo. A morfologia dos neurônios GnRH também é única, uma vez que seus dendritos também podem funcionar como axônios, dando-lhes uma função distinta. Pode ser tardia e o animal demorar para estar apto a reprodução; precoce e o animal entrar na vida reprodutiva antes do esperado ou pode ser normal e o animal estar com boa conformação e idade. Para tanto, alguns fatores podem interferir à manifestação da puberdade pelos animais como a genética, idade e peso, nutrição, fotoperíodo e o próprio manejo adotado. -/- -/- Genética -/- O genótipo afeta a idade da puberdade, pois algumas raças são anteriores a outras. Nos bovinos, as raças europeias atingem a puberdade antes dos zebuínos, isto é, uma novilha ou novilho da raça holandesa atinge a puberdade primeiro que os animais da mesma idade e do mesmo peso da raça nelore, por exemplo. -/- Da mesma forma, as porcas da raça chinesa Meishan atingem a puberdade por volta dos 115 dias de idade, metade da idade das raças brancas. As ovelhas de raças de corte, da mesma forma, são mais precoces que os produtores de lã. As raças pequenas, da mesma forma, são geralmente mais precoces, pelo menos em bovinos (jersey x guzerá) e em caninos. Os híbridos, por outro lado, apresentam puberdade mais precoce que os puros, devido ao efeito da heterose. Por este motivo, em certas espécies são utilizadas linhas híbridas. -/- -/- Idade e peso -/- A tabela 1 mostra a idade média de início da puberdade em espécies domésticas. O peso vivo (PV) adulto é mais relevante para a idade na puberdade nos ruminantes, enquanto em suínos é menos decisivo. A superalimentação também não é recomendada, pois pode alterar tanto os sinais que são recebidos pelo hipotálamo quanto sua resposta a eles. -/- Logo, o manejo alimentar adotado deve estar de acordo com as normas estabeleci-das pelos especialistas na área, principalmente no tocante as exigências nutricionais que devem servir de regra na propriedade. Sendo assim, os animais entrarão em puberdade com as taxas de alta qualidade o que afetará positivamente na prole futura e dará retorno lucrativo ao proprietário. -/- -/- Época do ano (Fotoperíodo) -/- Em fêmeas de espécies sazonais, como ovelhas e cabras, existem certos requisitos de fotoperíodo que devem ser atendidos para que a puberdade ocorra. Nessas espécies, um período de exposição a dias longos é necessário, seguido por outro de exposição a dias curtos. Na verdade, os cordeiros e cabritos nascidos fora da estação, mesmo que tenham atingido o peso necessário, terão que esperar até o outono seguinte (a estação reprodutiva) para atingir a puberdade. Os machos, por outro lado, não estão sujeitos a essas limitações nos requisitos fotoperiódicos para apresentar a puberdade. -/- Em novilhas nascidas no outono, por outro lado, a puberdade ocorre antes de um ano de idade, no verão seguinte ou no início do outono, mais cedo do que nas nascidas na primavera, devido à exposição a longos dias durante os primeiros seis meses do ano após seu nascimento aceleram seu crescimento. Em gatos, o aumento do fotoperíodo também acelera o início da puberdade. -/- Em ovelhas e novilhas, a primeira ovulação que ocorre ao entrar na puberdade é silenciosa; ou seja, não é acompanhada de sinais comportamentais de cio como a micção frequente, inchamento da vulva, uma montando a outra e deixando-se montar etc., pois para que esse comportamento se manifeste, o sistema nervoso necessita de uma pré-sensibilização com progesterona que não estará presente até o próximo ciclo, após o desenvolvimento do corpo lúteo vindo desta primeira ovulação. -/- -/- Sociossexual -/- A interação de indivíduos da mesma espécie ou a presença ou ausência de sinais de bioestimulação, como feromônios, pode afetar o período de puberdade. A puberdade, por exemplo, é atrasada em porcas criadas individualmente em comparação com porcas criadas em grupo. Além disso, na porca, ovelha e cabra, a exposição ao macho estimula as fêmeas e a puberdade aparece mais precocemente. -/- -/- Manejo -/- Certas práticas de manejo podem acelerar a puberdade, especialmente no período pré-púbere. Em porcas próximas à puberdade, por exemplo, o estresse causado por procedimentos, como o transporte de um local para outro ou a exposição ao macho, faz com que apareça o estro em torno de sete dias após a realização do manejo mencionado. -/- -/- • _____ESTACIONALIDADE REPRODUTIVA -/- A estacionalidade ou sazonalidade reprodutiva é uma estratégia evolutiva que se desenvolveu em algumas espécies; tende a tornar a reprodução mais eficiente. Nos países de latitudes distantes do equador, o objetivo é que as crias nasçam na primavera, época do ano mais favorável, graças à abundância de alimentos e às amenas condições climáticas. No caso da ovelha, cuja gestação dura cinco meses, para que os partos ocorram na primavera, ela deve engravidar no outono (figura 1), quando os dias são curtos; enquanto a égua, tendo uma gestação de aproximadamente 11 meses, deve conceber na primavera, quando os dias são longos; assim, o parto ocorrerá na primavera do ano seguinte (figura 2). -/- -/- Figura 1: Esquema ilustrativo da estacionalidade reprodutiva na espécie ovina. Ovinos e caprinos se reproduzem na época do ano em que os dias são curtos e os equinos quando são longos. O grau de sazonalidade depende da origem da raça. As raças nativas de países localizados em latitudes elevadas (> 50°,ovelhas: soay, blackface, suffolk; cabras: saanen, alpino francês, toggenburg; equinos: puro-sangue, hanoveriano) terão uma estacionalidade mais acentuada do que as latitudes menores ou mediterrâneas (ovelhas: merino; cabras: murciana granadina; equinos: quarto de milha). Também existem raças de latitudes próximas ao Equador cuja estacionalidade é baixa ou nula (ovelhas: raças de pelo, crioulas; cabras: raças africanas e asiáticas) (tabela 2). -/- Para a maioria das raças de ovinos e caprinos, a estação reprodutiva começa no final do verão e início do outono; caracteriza-se pela apresentação de ciclos estrais sucessivos, e termina no final do inverno, quando se inicia o anestro, que se caracteriza pela ausência de ovulação. Consequentemente, a pulsatilidade do LH também diminui, que agora é incapaz de induzir a maturação folicular, o aumento dos estrogênios, o pico pré-ovulatório de LH e, portanto, a ovulação. -/- Isso ocorre porque durante o anestro a sensibilidade do hipotálamo ao mecanismo de feedback negativo dos estrogênios e de outros fatores de origem não gonodal é aumentada. Ao aproximar-se da estação reprodutiva, a sensibilidade hipotalâmica diminui e o aumento da pulsatilidade do GnRH causa as mudanças que culminam na ovulação. Portanto, o mecanismo endócrino do anestro estacional é semelhante ao do anestro pré-púbere e de alguns outros tipos de anestro. -/- A estacionalidade é um bom exemplo da interação entre o meio ambiente e o sistema neuroendócrino, pois o organismo é capaz de traduzir um sinal externo ambiental, como o fotoperíodo, em um sinal hormonal interno, que neste caso é a melatonina. -/- A glândula pineal secreta melatonina durante as horas de escuridão. Os animais sazonais apresentam um ritmo reprodutivo endógeno, que é regulado por janelas de fotossensibilidade, determinadas por mudanças na duração do dia. O sinal luminoso é captado pela retina e conduzido, via nervo, pelo trato retino-hipotalâmico até o núcleo supraquiasmático, que funciona como o relógio biológico do corpo. Daí o sinal viaja para o núcleo para-ventricular, depois para o gânglio cervical e, finalmente, para a glândula pineal, que responde secretando melatonina (figura 3). -/- Nas ovelhas, a estação reprodutiva começa quando a duração do dia diminui e, naturalmente, a noite aumenta; na égua, ocorre quando os dias se alongam. -/- A primavera não é necessariamente a melhor época do ano em todas as regiões do globo. Is reality the basis of everything or has reality itself an other basis? What makes reality – not the real things – to be active, to exist? The question of what is real seems to be an easy question, because in our daily lives we are and must be naive realists. We ourselves, the things around us, the world, the facts, all that is real. there must be several concepts of reality if we want to say that not only physical (...) or material things of everyday life are real, e. g. numbers, π, Dr. Faustus, thoughts, emotions and other things. On the other hand, given the difference of classical physics and modern physics, we see that even that form of knowledge, which seems to be most responsible for reality, natural science, cannot give the desired uniqueness in terms of what itself wants or needs to understand as real. Alternatively, when we see that nothing can be and nothing can be real without being in a world, and when we understand the world as the order of things, which I call worldI , then this leads us to the speculative answer that it is exactly the “unreal” worldI which is the reason why the everyday reality, worldI I , is real. The worldI is the basis for the reality of our empirical worldI I . The considerations presented here have nothing to do with the idealistic conception of possibility, founded in the power of the subject, nor with the existential concept of potentiality, founded in the Entwurf des Daseins. In the past Boethius was primarily considered to be the author of the Consolatio, or a theologician or logician. But as a philosopher he was the first to reflect on the concept of person, while Augustinus and others only made use of this concept. It is the purpose of this article to show that it was exactly Boethius’ situation in the late antiquity with its many differing traditions that urged and enabled him to ask himself what person essentially is. Foucault’s disciplinary society and his notion of panopticism are often invoked in discussions regarding electronic surveillance. Against this use of Foucault, I argue that contemporary trends in surveillance technology abstract human bodies from their territorial settings, separating them into a series of discrete flows through what Deleuze will term, the surveillant assemblage. The surveillant assemblage and its product, the socially sorted body, aim less at molding, punishing and controlling the body and more at triggering events of in- and ex-clusion from (...) life opportunities. The meaning of the body as monitored by latest generation vision technologies formed from machine only surveillance has been transformed. Such a body is no longer disciplinary in the Foucauldian sense. It is a virtual/flesh interface broken into discrete data flows whose comparison and breakage generate bodies as both legible and eligible (or illegible). (shrink)

One of these norms–of greatest importance for the discourse about being–is the distinction between the affirmation and the content of a proposition. With overwhelming conviction the standard-interpretation of the Aristotelian philosophy translates the Greek ousia with the Latin substantia. There are many reasons, that this translation and equation is false, in a short overview I name six of them.

Blame is multifarious. It can be passionate or dispassionate. It can be expressed or kept private. We blame both the living and the dead. And we blame ourselves as well as others. What’s more, we blame ourselves, not only for our moral failings, but also for our non-moral failings: for our aesthetic bad taste, gustatory self-indulgence, or poor athletic performance. And we blame ourselves both for things over which we exerted agential control (e.g., our voluntary acts) and for things over (...) which we lacked such control (e.g., our desires, beliefs, and intentions). I argue that, despite this manifest diversity in our blaming practices, it’s possible to provide comprehensive account of blame. Indeed, I propose a set of necessary and sufficient conditions that aims to specify blame’s extension in terms of its constitution as opposed to its function. And I argue that this proposal has a number of advantages beyond accounting for blame in all its disparate forms. For one, it can account for the fact that one’s having had control over whether one was to φ is a necessary condition for one’s being fittingly blamed for having φ-ed. For another, it can account for why, unlike fitting shame, fitting blame is always deserved, which in turn explains why there is something morally problematic about ridding oneself of one’s fitting self-blame (e.g., one’s fitting guilt). Aristotle is often called the father of the history of philosophy. However, if his references to earlier theses are to be taken as historical reports in our sense, then they must also be subject to historical critique – which is much to their disadvantage. However, looking through the function of his doxographies and furthter references to earlier theses shows that such a historical view is an anachronism in a way similar to the expectation of finding science in Aristotle. Rather the (...) references are made in a topical attitude. In this way the outlindes of the dominant opinions become explicit and only thereby argumentatively accessible. At the same time the unavoidable integration into tradition is consciously realised. (shrink)

This is an encyclopedia entry on consequentializing. It explains what consequentializing is, what makes it possible, why someone might be motivated to consequentialize, and how to consequentialize a non-consequentialist theory.

This article shows the origin of the famous Aristotelian expression τὸ τί ἦν εἶναι in everyday language. The expression is analysable in τὸ εἶναι and τί ἦν, and this part is the core of the common language question τουτὶ τί ἦν; or τουτὶ τί ἦν τὸ πρᾶγμα; always in imperfect form. This question is often found in Aristophanes’ comedies, which represent common Attic language. The imperfect ἦν is noted as a common Attic form indicating the present already by early comentators (...) of Aristotle as Alexander of Aphrodisias, the scholia to Aristophanes, later by Budaeus, but also in the modern Greek Lexikon of D. Demetrakos. Therefore not the imperfect is the problem, by mere embarrassement it was called "philosophic." The situations in the Aristophanean comedies, in which the question occurs, show that the thing about which somebody asks, is present, in front of the speaker, that it is an individual thing and something absolutly unexspected. The questioner will ask "What on the whole is this?" He asks about the first ground of being of the thing. The term τὸ τί ἦν εἶναι quotes only the use of εἶναι in this question in common language (like many other terms are quotations as τὸ τί ἐστίν; τὸ οὗ ἕνεκα etc.) and may be paraphrased by "Think of ’to be’ as you use it in the question ’What at all is this?’ " See also my article: Sonderegger (2001). The aim of this article is to free Aristotle's Metaphysics, especially book XII (Lambda), frome some metaphysical and theological presuppositions by detecting their inappropriate conceptual framwork, which once was progressive, but now holds an obsolete position. Ousia, being (not substance, a much later concept, construed to solve other problems than Aristotle's), stand for a question, not for an answer. Book Lambda develops a highly speculative argument for this queston. The famous noesis noeseos says that empirical being and knowledge is the (...) realization of a noetic structure (noesis), laid down in our most fundamental opinioons about being. (shrink)

The leading question of our lecture series is in which areas and in which sense fractures and incompleteness are relevant for us. Are brokenness and incompleteness only accidental and singular, or do they belong to the style of things in general? Is wholeness and perfection the rule, and fracture the exception? The same question must be applied to the distinction between our knowledge of the world and the world itself. Is brokenness and incompleteness due to the things themselves, or only (...) to our perception and knowledge of them? - For the time being, the term "world" will be used in the sense of the "whole of things", which is usual, later this term of the world will be supplemented by a second one. Crime-preventing neurointerventions (CPNs) are increasingly being used or advocated for crime prevention. There is increasing use of testosterone-lowering agents to prevent recidivism in sexual offenders, and strong political and scientific interest in developing pharmaceutical treatments for psychopathy and anti-social behaviour. Recent developments suggest that we may ultimately have at our disposal a range of drugs capable of suppressing violent aggression, and it is not difficult to imagine possible applications of such drugs in crime prevention. But should neurointerventions be used in (...) crime prevention, and may the state ever permissibly impose CPNs as part of the criminal justice process? It is widely thought that preventing recidivism is one of the aims of criminal justice, yet existing means of pursuing this aim are often poorly effective, restrictive of basic freedoms, and harmful. Incarceration, for example, tends to be disruptive of personal relationships and careers, detrimental to physical and mental health, highly restrictive of freedom of movement and association, and rarely more than modestly effective at preventing recidivism. Neurointerventions hold the promise of preventing recidivism in ways that are more effective and more humane, but the use of CPNs in criminal justice raises several ethical concerns. CPNs could be highly intrusive and may threaten fundamental human values, such as bodily integrity and freedom of thought, and humanity has a track record of misguided, harmful, and unwarrantedly coercive use of neurotechnological ‘solutions’ to criminality. This collection brings together original contributions from emerging scholars and internationally renowned moral and political philosophers to address these issues. (shrink)

The present text is the revised and corrected English translation of the book published in German by the Lang Verlag, Bern 2008. Unfortunately the text still has some minor flaws (especially in the Index Locorum) but they do not concern the main thesis or the arguments. It will still be the final version, especially considering my age. It is among the most widespread and the least questioned convictions that in Metaphysics Lambda Aristotle presents a theology which has its basis in (...) a metaphysics of substance. Doubts about theological interpretation are beginning to stir in a growing number of publications, but nevertheless the majority of research literature, compendiums and histories of philosophy argues within this frame. A closer look at the facts reveals that this conviction has no basis in the text. Quite the contrary it is based on a reception with theological interests. It arised over centuries, starting from Patristic times and the Middle Ages; it was influenced by Neoplatonic texts as the Liber de Causis or the Theologia Aristotelis, texts for a long time considered as original Aristotelian books. And, if you read not translations but the Greek text, you see that the word 'god' occurs much less than in a theological book should be. In some translations we find more occurences of that word, and especially in French, Italian, English translations some words as le Bien, l'Intelligence etc. are written with capitals to inticate that it is about god. To make it even more clear, we read often the term 'First Mover' or 'Unmoved Mover' as an other name for god, but this expression is never used by Aristotle. So the reader has the impression that Aristotle speaks continuously about god. In addition, in the present book you will find arguments which clean up with the outdated concept of substance in the Aristotelian text, a concept which was developed for quite other problems than Aristotle had, namely theolgical ones. And, if there is no substance, there is no corresponding metaphysics of substance and no theology or onto-theology. If substance, metyphysics, theology play no role in Metaphysics Lambda, what else is its content and aim? That is not so difficult to say because Aristotle says it sufficiently clear in his first sentence, περὶ οὐσίας ἡ θεωρία: our inquiry is about being; its aim is to develop the Frage nach dem Sein and to state a speculative answer: being is noesis, Sein ist Gewahren. Today, there are many natural sciences, one of which is physics, but there is no science in the sense of a Theory of Nature. In our everyday life, the opinion is rightly held that there is only one nature, but whether this opinion stands up to reflection is questionable. When we apply the speculation that Aristotle developed in Metaphysics Λ to his Physics, we will see, that Aristotle has developed a Theory of Nature that consists in posing the question of (...) the being of the natural being (Frage nach dem Sein des Naturseienden). The standardinterpretation wants us to believe that Aristotle founded a substance metaphysics with a corresponding theology, and that he practised natural science. But, our hermeneutical situation could lead us to an "Aristotle today" and free us from old beliefs so that we, like Thomas Aquinas and others, could learn from a contemporary Aristotle as an immediate interlocutor. One of the learning points, for example, would be that questions are more crucial than new assertions, even if they are sophisticated, and that unassertive thinking (unbehauptendes Denken) in a topical attitude can lead us to insight into the multiplicity of worlds. This insight would have immediate consequences for our behaviour towards our co-inhabitants of our planet and towards our environment. (shrink)

Discussions about the content of Plato’s Gorgias mostly follow the structure of this dialogue given by the change of the interlocutors. As plain as this change is, as little does it correspond with the development of the subject. This becomes obvious if we compare the division of the dialogue by the interlocutors with the division of the leading questions. New themes do not start with a new person, but only in the course of the conversation with Gorgias, Polos, and Callicles (...) respectively Socrates gets a more fundamental niveau for an old question or introduces a new subject. In this paper, I take it for granted both that there are two types of blameworthiness—accountability blameworthiness and attributability blameworthiness—and that avoidability is necessary only for the former. My task, then, is to explain why avoidability is necessary for accountability blameworthiness but not for attributability blameworthiness. I argue that what explains this is both the fact that these two types of blameworthiness make different sorts of reactive attitudes fitting and that only one of these two types of attitudes requires having (...) been able to refrain from φ-ing in order for them to be fitting. This paper examines the notion of the biopolitical body from the standpoint of Foucault’s logic of the security mechanism and the history he tells of vaccine technology. It then investigates how the increasing importance of the genetic code for determining the meaning and limits of the human in the field of 20th century cell biology has been a cause for ongoing transformation in the practices that currently extend vaccine research and development. I argue that these transformations mark the emergence of (...) a new kind of medical subject – the stabilized and infinitely reproducible human cell line – and that the practices and markets exploiting this new form of organism have had a destabilizing effect on the very biopolitical structures that engendered them and, in fact, mark a new way of conceiving the possibilities of cellular life. I call these new ways of organizing power that intervene in the logic of the security measure by mediating the relationship between populations and persons the microbiopolitical. (shrink)

For those familiar with Machiavelli’s texts, Foucault’s interpretation of Macchiavelli in his 1978 lecture series Sécurité, Territoire, Population1 is surprising. Although Machiavelli figures prominently in five of the thirteen lectures,2 Foucault treats Machiavelli as if he were the author of only one book—The Prince—and his reading treats this complex text as if it covered only one topic: how to guarantee the security of the Prince. Clearly Foucault did not intend his interpretation of Machiavelli as a close exegesis. Other discussions of (...) Foucault’s treatment of Machiavelli have acknowledged the role Machiavelli plays in these lectures and even note the inadequacy of the interpretation given by Foucault, but most commentators do not pursue Foucault’s reading further.3 This investigation is not concerned with whether Foucault got Machiavelli right. Rather, Foucault’s reading of Machiavelli is noteworthy because it is partial and incomplete in a way reminiscent of Foucault’s reading of Hobbes in, Il faut défendre la société. This fragmentary character of Foucault’s inscription of Machiavelli as a forerunner of the history of biopolitique allows an innovative reading of the Florentine that connects Machiavelli’s thinking, however indirectly, on a trajectory that encounters, for instance, Foucault’s analysis of populations, the police state, and even his reading of liberalism during the 1978-­‐ 1979 lectures. My argument here is that the specific way Foucault’s inscribes Machiavelli in the history of gouvernementalité, while seeming to reject him, in fact acts to resuscitate, and thereby relay, a reading of Machiavelli as a thinker who articulates encounters among political practices engaged within a horizon of radical immanence. There is, on a given moral view, an agent-centered restriction against performing acts of a certain type if that view prohibits agents from performing an instance of that act-type even to prevent two or more others from each performing a morally comparable instance of that act-type. The fact that commonsense morality includes many such agent-centered restrictions has been seen by several philosophers as a decisive objection against consequentialism. Despite this, I argue that agent-centered restrictions are more plausibly accommodated within a (...) consequentialist framework than within the more standard side-constraint framework. For I argue that when we combine agent-relative consequentialism with a Kantian theory of value, we arrive at a version of consequentialism, which I call 'Kantsequentialism', that has several advantages over the standard side-constraint approach to accommodating constraints. What’s more, I argue that Kantsequentialism doesn’t have any of the disadvantages that critics of consequentializing have presumed that such a theory must have. (shrink)

Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. These visuals help make the structures, strategies, and vulnerabilities of legal reasoning accessible to both legal professionals and laypeople. (shrink)

After raising some minor philosophical points about Kevin Elliott’s A Tapestry of Values (2017), I argue that we should expand on the themes raised in the book and that philosophers of science need to pay as much attention to the loom of science (i.e., the institutional structures which guide the pursuit of science) as the tapestry of science. The loom of science includes such institutional aspects as patents, funding sources, and evaluation regimes that shape how science gets pursued, and that (...) attending to these aspects will enable us to provide more robust guidance on the values that infuse the tapestry of science. Globalisation Considering the Multitude of Worlds This book deals with globalisation, its foundations, its rise and fall and the question of its future. It discusses the conditions that have led, each in its own way, to the reduction of the many worlds to one. The first foundations were laid in the time of the discoveries, the earth was recognised and measured as a unified space. Missionary work and colonisation have made the geographical unit into a unity of fundamental beliefs, values (...) and Western European languages. The brisk trade with the colonies also unified the financial and economic situation of the conquered foreign worlds, which were managed according to Western patterns. The small gain of the political independence of the states achieved in the decolonisation movement was unfortunately destroyed by the great losses already suffered in the area of the fundamental values of the original worlds, their languages, their ways of living, their faith. In the new situation it became apparent that the economic dependence on the former colonial states was increasing rather than decreasing, the way of doing politics had remained by habit that of the colonial powers. Decolonisation was not a way back to the old world. Two metaphysical assumptions of globalisation are discussed in more detail. One is the assumption of realism that the world is one. This assumption justifies missionary and colonialist action. On the other hand, there is the thesis of liberalism that the being of the beings is its economic value. Against the realistic assumption of the one world, arguments are put forward which justify and make plausible the opposite assumption of a multitude of worlds. Now that the world is de facto one thanks to globalisation, and now that it is suffering from problems that affect all people, a new kind of globalisation is needed, one that recognises and respects different worlds on the one hand, but is nevertheless capable of tackling environmental, financial and social problems together. Depending on the subject, two very different ways of reasoning are used. In the preparatory historical part, the arguments are empirical and stick to details; in the part dealing with the justification of the multiplicity of worlds, the argumentation is theoretical, not to say speculative. I argue that Plato believes that the soul must be both the principle of motion and the subject of cognition because it moves things specifically by means of its thoughts. I begin by arguing that the soul moves things by means of such acts as examination and deliberation, and that this view is developed in response to Anaxagoras. I then argue that every kind of soul enjoys a kind of cognition, with even plant souls having a form of Aristotelian discrimination (...) (krisis), and that there is therefore no completely unintelligent, evil soul in the cosmos that can explain disorderly motions; as a result, the soul is not the principle of all motion but only motion in the cosmos after it has been ordered by the Demiurge. This thesis contends that the possession of a sense of humour would contribute considerably to the quality of human life. It is an exploration and discussion of some of the difficulties involved in justifying the development of humour in terms of a philosophy of education. In light of developments in the digital age with consequent changes in science, technology and society, the educated person of the future will have to be less concerned with the accumulated knowledge of the past than (...) with the development and interplay of social and natural environments. Such a person will need to have, more than ever, a sense of what is truly real and what is truly valuable in human life. If the primary purpose of education is the preparation of students for their future lives, educators are now faced with some challenging problems. Apart from the high social value of laughter, there is a recognized relationship between humour and intelligence. Knowing that the two are related proves to be a key factor in understanding the learning process and assuring that the development of a sense of humour in education is worthy of consideration. This chapter reviews recent philosophical and neuroethical literature on the morality of moral neuroenhancements. It first briefly outlines the main moral arguments that have been made concerning moral status neuroenhancements. These are neurointerventions that would augment the moral status of human persons. It then surveys recent debate regarding moral desirability neuroenhancements: neurointerventions that augment that the moral desirability of human character traits, motives or conduct. This debate has contested, among other claims (i) Ingmar Persson and Julian Savulescu’s contention that there (...) is a moral imperative to pursue the development of moral desirability neuroenhancements, (ii) Thomas Douglas’ claim that voluntarily undergoing moral desirability neuroenhancements would often be morally permissible, and (iii) David DeGrazia’s claim that moral desirability neuroenhancements would often be morally desirable. The chapter discusses a number of concerns that have been raised regarding moral desirability neuroenhancements, including concerns that they would restrict freedom, would produce only a superficial kind of moral improvement, would rely on technologies that are liable to be misused, and would frequently misfire, resulting in moral deterioration rather than moral improvement. Proclus' Stoicheiosis Theologike has had an enormous impact on Christian theological and philosophical thought; it has had a decisive influence on the theological interpretation of Aristotle's Metaphysics. However, the impact was less on the text itself than on the 'excerpt' translated from Arabic into Latin with the title Liber de Causis, which, like the Theologia Aristotelis (a compilation of Plotinian texts), was considered authentically Aristotelian. It was only Thomas, thanks to Moerbeke's translation of the Stoicheiosis Theologike, who realised that the (...) Liber de Causis was not a genuine Aristotelian text; nevertheless, he considered it to be fully compatible in meaning and intention with what Aristotle had thought and also used it accordingly in his argumentations. Although this was not the beginning of the theological reading of Aristotle's Metaphysics, this circumstance has completely cemented this conviction until today. -/- The conviction that Proclus' text is primarily a theological treatise has also persisted to this day (see the recent anthologies and monographs on Proclus, most recently Relire les Éléments de Théologie de Proclus, 2021). With my translation and commentary, I would like to counteract this limitation of Proclusian thought. Already the literary form of the text, 211 general propositions, shows that Proclus has something different in mind here than, for example, in his Platonic theology. I would like to make the philosophical content, the philosophical question of Proclus speak. In this text, Proclus poses the question of being and answers it by saying that being is to be understood as the unity of {staying-emerging-returning}. (shrink)

In this article, I argue that online echo chambers are in some cases and in some respects good. I do not attempt to refute arguments that they are harmful, but I argue that they are sometimes beneficial. In the first section, I argue that it is sometimes good to be insulated from views with which one disagrees. In the second section, I argue that the software-design principles that give rise to online echo chambers have a lot to recommend them. Further, (...) the opposing principle, serendipity, could give rise to serious harm, in light of the conclusion of the first section that sometimes we are better off being insulated from some content online. In the third section, I argue that polarization can be a useful tool for inculcating the appropriate attitudes in a person. (shrink)

What is the origin and goal of man? In this lecture to a small audience I will pursue this question by comparing passages from Platonic Philebus with those from Aristotle's Nicomachian Ethics and comparing both together with a passage from the Letter to Menoikeus. It turns out that the Aristotelian idea of eudaimonia (happiness) is not so far removed from Epicurus, since eudaimonia also includes hedone, lust.

This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...) contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented, covering pro-tanto and all-things-considered interpretive conclusions. (shrink)

Abstract Most histories of philosophy make us believe, that there is a line of thought from the Greeks on until today. This impression should be checked by this article. At first we contrast some pros and cons of the view that philosophy in general has a history. Then we come back to the question, if Plato or / and Aristotle are really the founders of historiography in philosophy. As test-piece we take the passage in the centre of Plato's Sophist, which (...) shows that the references to past thinkers don't have the purpose to inform us historically, but, first, to continue the current dialogue about being, second, to lead us to the aporie about being, which allows a fresh start for this question. A glance at the doxographies of Aristotle shows (we have a look at that of De Anima), that they have the same target in view, namely to reveal the fundamental opinions of being in a respective world. This way the “history of philosophy” becomes an account of succeeding worlds and the related reflection on it. – This article is an extended version of a short lecture held in Geneva, 15. sept. 2016, within the scope of the Symposium of the Schweizerische Philosophische Gesellschaft. Cusanus, Abstract As a rule Cusanus is interpreted in a theological way, under strong theological presuppositions and within the range of religion. This may be quite understandable since he was a cardinal and had important functions in the Papal States. But, what are the results, when we read his texts under pure philosophical conditions? We may see then that some of his texts are meant neither to assert a belief nor to search for reasons for it, but only to reflect (...) upon the presuppositions of this belief and its different traditions. Instead of asserting his belief Cusanus is beginning to reflect upon his presupositions. We try to give an exemple for this shift with the first proposition in the collection of propositions that follow the dialog De non aliud: „definitio quae se et omnia definit, ea est, quae per omnem mentem quaeritur.“ We will see a quite another Cusanus. Cusanus picks up „definitio“ in the sense of self-determination, developped in the dialog. He begins in quite a traditional manner and ends in a supremely abstract and speculative intuition. The 'Not-other' determines itself in a vision; this vision is an order in which every thing gets its proper place; we as human beings aspire to repeat this vision in our mental life in contact with the world. In this way Cusanus does what all great philosophers do: he reflects in a given set of opinions what is the meaning of „to be“. (shrink)

This article is featured in a special issue dedicated to theme, "the human being in the digital era: awareness, critical thinking and political space in the age of the internet and artificial intelligence." In this article, I consider the way that social-media companies nudge us to spend more time on their platforms, and I argue that, in principle, these nudges are morally permissible: they are not manipulative and do not violate any obvious moral rules. The moral problem, I argue, is (...) not with nudging in principle but is instead with the fact that users are being nudged towards something bad for them. In practice, this often involves being nudged to spend an unhealthy amount of time using a social-media app or being nudged towards content that is bad for us, such as by promoting eating-disorder content to young girls. Since nudging is morally permissible, it is open to these companies to use the same technologies to nudge us towards the good. (shrink)
